BACKGROUND
These General Terms and Conditions of Sale relate to the purchase via telematic or telephone mode of the products presented on the website "www.isaproject.it" and its subdomains, managed by ISAPROJECT SRL, with registered office in Florence (FI) Via Luigi Federico Menabrea 3 / A - 50136 FLORENCE VAT and CF 06659410481 registered in the REA of Florence n. 646 130
These General Conditions of Sale are an integral and essential part of the purchase contract for any product on the site.
Sending an order implies acceptance by the customer of the general conditions of sale in place.
Isaproject reserves the right to revise these General Conditions of Sale at any time without notice.
The protection of confidentiality (privacy) is governed by the provisions of Legislative Decree 196/2003.
1. CONCLUSION OF THE CONTRACT AND ACCEPTANCE OF THE GENERAL SALES CONDITIONS
1.1 The presentation of the products on the site www.isaproject.it and its subdomains, constitutes an invitation to users to formulate a purchase proposal towards SA Project. These invitations to offer are not binding for ISA Project.
1.2 Isaproject therefore reserves the right not to confirm an order for any reason relating in particular to a problem of product supply or to a problem concerning the order received.
1.3 The purchase contract for the tangible goods will be concluded by the "Customer" with ISA Project directly through the access to the website www.isaproject.it and its subdomains by carefully following the instructions and the procedures that will appear on the site from time to time. < / p>
1.4 After having read the general conditions of sale, by clicking on the PLACE ORDER button the Customer will accept the terms and the conditions of sale set out in this contract, and will authorize ISA Project, at the time of sending, to charge the total amount indicated, including the contribution for shipping costs where applicable.
The order number that will be assigned at the time of the purchase confirmation is generated progressively and is necessarily unique.
1.5. When ISA Project receives the order from the customer, it sends a confirmation email with the order summary, printable, which contains all the product data.
2. PRICES
2.1 All prices shown on the Site are expressed in Euros, do not include VAT and do not include any taxes, duties or taxes applicable in the country of destination of the products, where this is different from Italy, which will be charged to the customer. The prices of the products published from time to time on www.isaproject.it and its subdomains cancel and replace the previous ones and are subject to the effective availability of the products.
2.2 The price guaranteed to the buyer is the one published on the site at the time the order is sent without any consideration of any price changes that have occurred subsequently or previously.
2.3 The customer is responsible for choosing the products ordered and for the compliance and conformity of the specifications indicated by each manufacturer with their own needs.
3. PRODUCT FEATURES
3.1 The characteristics of the products are illustrated in the relative descriptive and technical sheets. The description of the products offered on the site is the one that the suppliers have communicated to ISA Project.
3.2 The images and colors of the products published on the site may differ from the real ones due to the local settings of the systems and / or tools used for their display. ISA Project is not responsible for the mismatch between the product published on the site and the ordered one, in the event that the mismatch derives from description errors attributable to the supplier and of which ISA Project was not aware and could not be using the normal diligence.
4. PAYMENT
The customer will pay the price of the ordered products in full, at the same time as placing the order.
The payment of the Products purchased online can be made by bank transfer, credit cards or paypal.
All transactions made will be made in favor of ISAPROJECT SRL
4.1 Payment by advance bank transfer

When the Customer uses this method of payment, Isaproject will be able to consider the order actually valid and therefore ship the goods only after verifying that the exact amount has been credited to its bank account. The reason to be reported on the bank transfer must indicate: the order number, the name and surname (or company data) of the originator.
4.2 Paypal payment
Payment via PayPal will be made in favor of Isaproject srl. In case of purchase through the PayPal payment method, at the conclusion of the order, the Customer is directed to the PayPal login page. The amount relating to the order is debited from the PayPal account when the order is acquired. In case of cancellation of the order, both by the Customer and in the case of non-acceptance of Isaproject srl, the amount will be refunded to the Customer's PayPal account.
Once the cancellation of the transaction has been requested, in no case ISA Project can be held responsible for any damages, direct or indirect, caused by delay in the failure to release the amount committed by PayPal. At no time during the purchase procedure ISA Project is able to know the customer's financial information. Since there is no data transmission, there is no possibility that this data will be intercepted. No ISA Project computer archive contains, nor does it store, such data. For each transaction made with the PayPal account, the Customer will receive a confirmation email from PayPal.
5. RESPONSIBILITY '
5.1. ISA Project will not be responsible for non-delivery or delayed delivery in the event that:
. despite having made the regular and timely purchase of products to cover the order received, it has not been supplied in the terms and ways agreed with the supplier,
. is unable to make up for the unavailability of these products, due to circumstances beyond its control.
. has promptly communicated this unavailability to the customer.
6. WARRANTIES
6.1 The products sold by ISA Project through the site www.isaproject.it and its subdomains, are covered by the manufacturer's conventional warranty and by the 24-month warranty for defects of conformity, pursuant to Legislative Decree 24/02. In order to benefit from the warranty assistance, the Customer must keep the invoice (or DDT) that he will receive via e-mail in PDF electronic format.
6.2 The 24-month warranty pursuant to Legislative Decree 24/02 applies to a product that has a lack of conformity which makes it unsuitable for its intended use or significantly reduces its value, provided that the product itself is used correctly, in compliance with its intended use and as provided in the attached technical documentation.
6.3 In the event that, for any reason, ISA Project is unable to return a product under warranty (restored or replaced), it will be able, at its discretion, to return the amount paid, taking into account the use of the asset or its replacement with a product of equal or superior characteristics.
6.4 The repair times or any replacement of the product depend exclusively on the manufacturer's policies and no damage can be requested from Isaproject for any delays in carrying out repairs or replacements.
6.5. In cases where the application of the guarantees provides for the return of the product, the goods must be returned by the customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment);
6.6 The Customer will be provided with an authorization number for the return of the product (RMA) which must be indicated outside the packaging, following the instructions provided directly in the relevant authorization e-mail.
7. BILLING
7.1. For each order placed on www.isaproject.it and its subdomains, ISA Project can issue an invoice for the material sent on specific customer request. If the invoice is necessary, the customer is required to communicate it during the purchase process, indicating the VAT number and / or Tax Code on the order form. (DL N. 633/72 ART. 22 OF THE Dp).
7.2 The shipping costs will depend on the volumetric weight, or on the value determined through a conversion factor that translates a volume into taxable kilograms.
7.3 To calculate the shipping costs, the customer must enter the products he intends to purchase in the cart and specify the country, city and postal code of delivery to obtain the automatic calculation of the system based on the rates entered, or contact the customer support [email protected] for a personalized quote.
7.4. For deliveries to European Union and international countries, the shipping fee is indicated on the confirmation page when ordering. Customs fees and taxes relating to the country where the delivery will be made, are the responsibility of the buyer.
8. SHIPPING
8.1. The times of availability and delivery of the ordered Products are specified in the product sheet and are those provided by the manufacturers. ISA Project cannot be held responsible for delays in delivery attributable to the manufacturer
8.2. The shipment of the ordered products is normally carried out by affiliated couriers BARTOLINI, SDA, FERCAM SPA depending on whether the service chosen is Standard or Express. ISA Project has the right, at its sole discretion, to carry out the delivery of the products ordered by means of a courier other than the aforementioned.
8.3. The delivery of what is ordered is on the street level.
No delivery to the floor and / or special porters is expected. If the customer needs these extra services, he must request a specific quote from ISAPROJECT by sending an e-mail and specifying the characteristics of the requested service.
8.4. Upon delivery of the goods by the courier, the customer is required to check:
. that the number of packages delivered corresponds to what is indicated in the transport document sent in advance by e-mail;
. that the packaging is intact, not damaged, wet or in any way altered, even in the sealing materials (adhesive tape or metal straps).
Any damage to the packaging and / or the product or the mismatch in the number of packages or indications must be immediately contested by affixing a WRITTEN CONTROL RESERVE (SPECIFYING THE REASON FOR THE RESERVE, eg "laundry packaging", " crushed packaging ", etc.) on the courier's proof of delivery.
Even if the packaging does not present external signs of damage or tampering, the customer is still required to affix the words "I ACCEPT WITH RESERVE OF CONTROL" on the proof of delivery of the courier in order to guarantee against hidden damage to the object not visible from the outside.
Failure to affix this wording will result in the courier's failure to activate the warranty and void the right to replace the damaged object.
8.5 Once the courier's document has been signed, the Customer cannot make any objection regarding the external characteristics of what has been delivered.
Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 7 days of delivery, according to the methods provided in this document.
8.6. In the event of non-collection within 5 working days of the material present in stock at the courier's warehouses due to repeated impossibility of delivery to the address indicated by the Customer at the time of the order, the order will be returned to the ISA Project warehouses < / p>
8.7. Shipping costs for major islands, smaller islands, disadvantaged or limited accessibility areas (ZTL or similar) may be subject to variations.
9. RIGHT OF WITHDRAWAL
Pursuant to art. 5 DL 185/1999, the right of withdrawal does not apply to the professional (i.e. a natural person who buys the goods for purposes related to his professional activity, or does make the purchase by indicating in the order form to Isaproject a VAT number reference).
10. PERSONAL DATA PROCESSING
Isaproject pursuant to art. 13 of Legislative Decree 196/2003 informs that personal, personal and tax data acquired verbally in reference to the commercial relationships established, provided directly by the interested parties, will be processed in compliance with the aforementioned legislation and for the purposes mentioned above, including obligations of confidentiality provided by them. In relation to the aforementioned, the rights referred to in Article 7 of Legislative Decree 196/2003

11. COMPLAINTS

The customer will be contacted for clarification within 3 working days of the request.
12. COMPETENT COURT
This contract is subject to Italian jurisdiction. These general conditions, although not expressly provided for, refer to the rules on purchase contacts stipulated at a distance (in the case of remote contracts by means of a telematic network) of the civil code, of Legislative Decree 185 / 1999, of Legislative Decree 70/2003 and of Legislative Decree 206/2005. Any dispute relating to the application, execution, interpretation and termination of this contract will be devolved to the exclusive jurisdiction of the Court of Florence
